The radio rack certainly is far behind the area of the second seat area, the fuel tank is a self sealing (rubber)type, and certainly could not be considered as a structural component.
Come to think of it, I have never seen a photo of a P-40 with a broken back - perhaps you are thinking of another aircraft type.
